You are a lawyer. Connie, a resident of Tennessee, has come to you for help. Connie is a fashionista. She has developed an iPhone app in which a person can take a picture of a piece of clothing and the app will identify the manufacturer of the clothing and then take you to the manufacturer’s website to view and order the clothing. Connie’s app caught the attention of IST Partners, a technology conglomerate from California. Connie signed a contract to sell her app to IST. IST, however, has decided to use the platform to identify household items instead of clothing. IST believes the app will have a larger appeal through this use and, thus, will be more profitable. Connie is upset that her app will not be used to identify clothing. She wants to sue IST in Tennessee for breaching the contract.

Connie also suffered serious injuries about two months ago when she slipped in a puddle of water at Wal-Mart and fell. She landed on her left arm and shoulder, breaking her arm and collarbone. Connie wants to sue Wal-Mart for her injuries. She needs to know her options. Connie stresses to you that she would like a quick resolution because she needs the money to help pay her bills and other living expenses.

Please advise Connie about suing IST. Can you help her sue IST, or do you need additional information? If you need additional information, please identify what information you need. Next, please advise Connie what options she has in pursuing her potential claim against Wal-Mart, including what course of action you would ultimately recommend.

This assignment is limited to the material covered this week. I am not testing breach of contract or negligence law. As such, you should not analyze Connie’s likelihood of success on a breach of contract or negligence claim. We cover these topics in later weeks.

Lincoln on Leadership Paper Submission:  Students will read the novel Lincoln on Leadership and write a five (5) page summary of the Lincoln on Leadership book in APA format.  Your paper must include a cover page, abstract, brief introduction/overview (communicate to the reader what key themes you are conveying in your paper). The body of the paper must include the message that you as a leader want to convey to the reader about the book.  The conclusion of the paper must communicate to the reader some key takeaways, such as lessons learned from the book.  You must include a bibliography page.  The cover pager, abstract and bibliography do NOT count toward your five (5) page summary.

Choose one task and write a one-page summary/reflection that addresses specifically what you gained from the experience and how the experience aligned with one of the course student learning objectives.

Options include (but are not limited to):

  Conduct an open dialogue interview (with prepared questions) lasting about one hour with a parent of a child with a disability (or older student who has a disability)

  Interview a special education teacher currently teaching students with special needs for about one hour; develop a format of questions and type up the responses

  Attend an ARD meeting or 504 meeting as an observer and write a 1 page paper on the process (instructor approval in advance required.)

  App Analysis: Create a list of 25 of the most useful Apps that could be used to modify, accommodate, or differentiate instruction in your desired content/grade level. Indicate a brief idea for how each could be used and provide access to a brief description of each app

  Arrange to observe for about 2 hours in a self-contained special education classroom.

  Develop a plan for a student with a disability to be included in a general education class. Include the following components (See chapter 5): (a) identify classroom demands (4 major areas); (b) note student learning strengths and needs; (c) use information to brainstorm ways to differentiate instruction; and (d) a summary narrative description regarding how the student will participate in the general education curriculum.

  Locate and visit an assistive technology center in your area. Talk with staff of the center. Investigate and describe briefly the resources they have, how the center is used, how friendly it feels for children, families, and teachers. Describe how these resources might be used to assist inclusive teaching. Your paper should be at least 3 handwritten pages or 1-1/2 typewritten pages.

B. Research Project: Victims of Police-Involved Deaths

At the end of the book on page 443, Starr says, It would be easy to quit if it was just about me, Khalil, that night and that cop. She then lists names including, Aiyana, Trayvon, Eric etc. that These are all people who have been impacted by police brutality, police misconduct (including situations resulting in death) and/or shootings. Starr adds, The messed up part? There are so many more. In this activity, you will engage in a research project about these individuals, all of whom have been impacted by police-involved deaths. In the book, the author only includes their first names but their last names are included here: Oscar Grant, Eric Garner, Freddie Gray, Aiyana Stanley-Jones, Tamir Rice, Alton Sterling, Trayvon Martin, John Crawford, Philando Castile, Rekia Boyd, Ezell Ford, Michael Brown, Sandra Bland. Choose one of these names on which to conduct your research and write an essay about their life/death. Consider the following questions:

What happened?
What were the circumstances around the persons death?
How did the community and nation respond (or not respond)?
How did news media and social media portray the person and their death?
What are your thoughts and opinions about the case?
How was the case handled?
How do you think it should have been handled?
