Case Brief
Understanding the opinion in a case is very important because sometimes the only primary source available for the resolution of a legal issue is case law. Also, some professions require you to keep up to date with changes in statutes or regulations that are also affected by case law.
Using the case brief format presented in Chapter 4 on pages 131–132 of the book, read and brief U.S. v. Leon, 466 U.S. 897 (1984). This case is located in page 624, Appendix A of the book.
Your Assignment must have a title page in APA format. All of the legal sources used in the Assignment itself must be in Bluebook format.
Using Primary and Secondary Sources
Primary and secondary sources can complement each other to help you understand a particular area of law that might not be so clear. For this Discussion, you will learn how to use primary and secondary sources together. Using Westlaw, locate a primary source from your state that defines “trade secret.” If there are no primary sources, research federal primary sources. When you cite the primary source(s), make sure you use correct Bluebook format.
Next, using Westlaw, locate a secondary source that discusses trade secrets. Also use correct Bluebook format when citing the secondary source. Explain the secondary source and how it explains or complements the primary source.
Why Bluebook
Why is it important to use Bluebook citation? If you do not intend to enter the legal field, why would you use citations? Why must citations be so precise? Can you think of some careers other than law that would require you to use citations?
WRITING ASSIGNMENT – Problem Statement & Research Objectives
Write a paper of approximately 750 words based on your topic research and preliminary literature review, that answers the following:
- Problem Statement
- Revised/refine the preliminary problem statement from the Week 1 assignment. This will be the problem statement for your final project.
- Based on the research you conducted on your topic in Week 1, write a brief history and/or context of the problem, including why this is a problem and the consequences of the problem.
- Research Objectives
- Develop and explain at least two preliminary research objectives and how you plan to apply the methods of scientific inquiry to your research topic.
- Describe how you plan to apply ethical guidelines and standards when writing your research proposal for your final project.
- Develop at least one preliminary hypothesis statement.

Unit 5 Discussion
The Internet is a universe in which a wealth of information is accessible to anyone, anywhere, at any time. Searches can find information on a vast range of topics from how to fry an egg, to how to make a tesla turbine. Legal Analysis
For this Assignment, you will practice stating an issue and identifying the rule of law and show how they relate to the facts of a case.
In each fact situation for this Assignment, a statement was made by a juvenile without the presence of a parent, guardian, or legal custodian and without advisement of the juvenile’s rights. The question is whether each statement is admissible. For each of the following fact situations, draft a comprehensive, or narrow, statement of the issue in the law + question + key facts format, as presented in the textbook. Each statement of the issue should be only one sentence, and should be in the form of a question. Bear in mind that the statement will begin with the applicable law, followed by the question, and will conclude with the key facts that relate to the the law and question. Please refer to the textbook for a detailed explanation of how to draft a statement of the issue in the law + question + key facts format. For the law component, use the Colorado statute presented below. When drafting the law component, include the citation and a relevant portion of the title.
Each section (statement of the issue in the law, question, and key facts) should be comprehensive and specific. You must address each component in complete sentences, not in bullets or lists. All authorities must be in Bluebook format.
Statute: The statute is Colo. Rev. Stat. Ann. § 19-2-511. The title of the statute is “Statements.” This Colorado statute governs the admissibility of statements concerning delinquent acts made by a juvenile as a result of custodial interrogation by law enforcement officers. The statute provides that such statements are not admissible unless a parent, guardian, or legal custodian of the juvenile was present at the interrogation and that the juvenile and the parent, guardian, or legal custodian was advised of the juvenile’s rights.
Statement made by the juvenile without the presence of a parent, guardian, or legal custodian and without advisement of the juvenile’s rights:
- Prior to her interrogation, Beth told the police that she was 18 years old. Beth appears to be at least 18 years old.
- The principal and the school’s security officer interrogated Larry about his part in a theft that took place at the school.
- Tom was stopped for speeding. While he was stopped, the police officer giving Tom the ticket interrogated him concerning the speeding offense.
- Alice and a group of students were arrested at a party for curfew violation. On the way to the police station, Alice confessed to the police officer that she was drunk without the officer having asked her any questions
Discussion Unit 6
As you have learned, stating the facts is the first step in analyzing a legal issue. This is a very important step because the facts must bear relevance to the issue. Remember that the analysis will be based on the facts, and the facts will lead you to the answer of the legal problem.
For this week’s Discussion, read Assignment 14 on pages 529–530 in Chapter 17 of the textbook. What facts are important and what is the issue? Remember that the facts of a case should relate to the issue as they will eventually be the basis for your analysis and conclusion once you apply the rule of law. Also, the issue should be narrow and presented in the form of a question.
