Three different tests have been devised to establish if there is a duty of care, has it been breached and was it foreseeable. With the first being the Neighbour test this was the first and was introduced by Lord Atkins, the other tests were derived from this test. Because the Neighbour test was too broad the Anns test was established by Lord Wilberforce, but just for manufacturing. His test included two stages: e-lawresources (n,d)

’ 1. Examine whether the loss was reasonably foreseeable and there existed a relationship of proximity. If so a prima facie duty of care arises.

2. The defendant may put forward policy considerations to negate liability.’

However, they still thought this was too broad and so the Caparo test was brought in. Under this test it has to be established; e-lawresources (n,d)

‘1. That harm was reasonably foreseeable

2. That there was a relationship of proximity

3. That it is fair, just and reasonable to impose a duty of care’

All of these tests have shown that it has to be foreseeable, there must be a proximity and it must be fair to expect a duty of care.

An example of this would be the major crash on M5 in 2011. In which 34 cars were involved in a crash caused by a mixture of fog and smoke, which killed 7 and injured 51. A car crash in these circumstances is foreseeable however, having a firework display close to the road and adding to the fog was not.

An employment contract can not cover all aspects of the employer, employee relationship (Truss, et al., 2012). It can only specify what tasks are required by the employee and for what reimbursement. An employee handbook lays out a set of principles that are expected of an employee and in turn address the type of corporate environment it is attempting to create.

Contractual Rights, as an employee are different from Statutory Rights, and again are diverse from whether an employee is committed or engaged to an organisation. (Beardwell & Claydon, 2010) highlight Lagge’s (2005: 105-06) unitary theory that “communication, motivation and leadership” are crucial factors in generating commitment from employees. One of the key elements to HRM and SHRM is employee buy-in, it is not enough for an individual to be competent at their job, they must also contribute to the overall strategic goal. Dynamic, innovative etc. The employer, offers the employee the platform to accomplish this. I believe that is (as least one, if not a foundational piece of) the “cost” of an employee employer relationship.

HRM may set the parameters of how an organisation recruits, retains and develops resources, but it must be in collaboration with Line managers. HRM do not manage other departments (they may steer them, but that is the breadth of their influence).

Would you agree or disagree that it is the corporate culture that dictates the style of Line management, encouraged by a reactive (instead of proactive) HRM, with poor resource planning and engagement approaches?

The Pursuit of quality

One of the main challenges for small businesses facing rapid growth is maintaining the culture that helped them achieve success in the first place, and one key aspect of this is how to manage performance. When the whole company fitted into one office, it was easier to manage performance, share ideas and give feedback. As the company grew, systems were needed to support this process, without inhibiting their innovative and collaborative culture. 

Maximo decided some kind of formal process was needed, but wanted to maintain an informal and accessible approach to managing performance. They introduced performance review software that looked and felt like a computer game – colourful, intuitive and user-friendly. It enabled managers to review employees in the same way they worked, as a team. Objectives are set by senior management and all employees are then asked to set a goal for themselves, including a set of measurable objectives to help them achieve it. 

All employees have regular contact with their managers to review progress and any support requirements throughout the year, and at an annual review, the whole team receives a rating on a 5 point scale (needs improvement to amazing). Crucially this is not just based on the manager’s opinion; Maximo use a 360 degree feedback system to ensure every employee receives feedback from peers, managers and more junior colleagues to help them improve. Pay discussions happen 2 months after these reviews so financial concerns don’t get in the way of improving performance.

Unit 6 Managing the employment relationship

Within the culture of collaboration and trust, all employees are encouraged to show leadership in their own area. This is a key part of their success, leading to innovation and has resulted in a relaxed approach to employee relations. Each employee has their own needs and expectations to enable them to give their best, and these requirements are agreed individually with line managers. Two-way communication continues to be a central part of the culture. 

Employees are able to email questions to senior managers, and the most commonly asked are addressed at monthly huddles, that the whole company attends (either in person, or remotely). These huddles are also used to share information about what’s happening in the business, so employees can see where they fit in.
