Prior to beginning work on this discussion, read The Burden of Reasonable Doubt: When a Standard Designed to Protect Defendants Actually Hurts Them (Links to an external site.) and Federal and State Jurisdiction (Links to an external site.) Additionally, watch What Does Beyond a Reasonable Doubt Mean? (Links to an external site.)

A central component to any criminal case is the jurisdictional  requirement for a court to hear a criminal case. In your examinations  this week, focus on the power of jurisdiction and its significance as  part of the criminal justice system. Who creates jurisdiction, and why  is it so significant? Similarly, a sound understanding of the legal  requirement that the prosecution must prove every element of a statute  beyond a reasonable doubt is required for all criminal justice  professionals. This discussion requires you to examine reasonable doubt  instructions for juries from three states and choose which one is best;  remember to justify your responses with reliable sources.

  • If your last name begins with the letters A through L: Explain  the central components of the legal term and substantive criminal law  requirement for jurisdiction. At a minimum, your response must detail  all of the following:
    • What is jurisdiction, and how does it affect criminal prosecution?
    • Can the type of crime determine jurisdiction for a court?
    • Distinguish between federal and state jurisdiction for courts in criminal cases.

The Role of Boundaries

Boundaries are an important feature of any organization. The nature of these boundaries has undergone considerable change over time. For many organizations today, what is inside or outside the boundaries is less clear and the ease of flow of information across boundaries has greatly increased. Boundaries can exist between individuals, between teams, between organizations, or even between an organization and its social environment (e.g., city, community, etc.).

  • Discuss your current organization or a previous organization in terms of boundaries. How did these boundaries affect you as an employee? Reflect on your mental construct of boundaries.
  • Explain what roles boundaries play and why these are important to organizations.
  • How permeable are your boundaries both personally and for your team?
  • Examine what determines how much rigidity and permeability is required by an organization and the teams in an organization.
  • Assess the benefits for many organizations to be less rigid and more permeable than previously.

The final paragraph of your post (3 to 4 sentences) should summarize the one or two main points that you are attempting to make in your post.

You observe a licensed practical nurse (LPN) asking a patient for a cigarette as she escorts the patient to the exam room. Is this ethical behavior? What is appropriate or inappropriate about this patient interaction? Is the LPN violating the patient’s social, personal, or intimate space? How would you, as a healthcare administrator, handle the situation?

Please include the name of the person or question to which you are replying in the subject line. For example, “Tom’s response to Susan’s comment.”

Tara:

No this is not ethical behavior at all, even if the LPN was friends with the patients this is still not acceptable behavior for an employee. This incident is very unprofessional and as far as I am concerned the patients social, personal and intimate space as been violated. Some smokers do not want everyone to know they smoke and this would definitely violate there intimate because patient may think the LPN as went through their personal belongings.  This is inappropriate for many reasons, one being the patient is ill if in the hospital and  if they smoke nurses should be tempting them to smoke by asking for a cigarette, two if you smoke you should support your own habit. This is bad for entire health care facility and staff by not supporting the medical facts “smoking is bad for you”. It also under minds patients confidants. This is wrong in so many aspects.

Do you think the same person who receives cash payments should also prepare the bank reconciliation? Give at least one reason to support your answer.

Amy:

I do not believe that the same person should prepare the cash payments and the bank reconciliation.  A company needs to have a check and balance and if you have the same person doing both then who is checking behind that person.  Case in point, we have a local credit union where a lady was just charged with embezzlement.  This didn’t come up until after she retired and someone else was doing the statements and noticed a big discrepancy in the numbers.  Same thing here at work.  We are currently in the middle of inventory and if there is any discrepancy in the counts, then I have two people to check it before an adjustment is made.  We are all human and not saying that people are criminals or untruthful, but we all make mistakes.  There should always be someone checking behind another person.

For this REP III,  no extra title page is required.  There are two prompts for this REP III please stay in the 4 page (total) limit as much as you can.

1. Corsaro (2018) aptly finishes his book with a profound sentence “The future of childhood is present” , discuss what he means with this sentence and what you take away from it.  You can direct this issue and your reflections into any direction you want to.

2. How can we apply the “interpretive reproduction” in peer groups idea to what we have read so far from the “American Girls” book?

This paper will have an 8-page narrative (8 pages maximum – 5 point deduction for over page limit) plus a title page, abstract page, and reference list.

You must use a minimum of four original research articles for your paper.

The purpose is to write a review of the literature on to answer your PICOT question using original research evidence. Discuss how this health problem is applicable in both the United States and a non-USA country, and appraise four original research studies on this topic.

This is a scholarly paper, written as if it was a “Review of the Literature” article published in a nursing journal. Select articles published within the past five years (2014 to present).
Do not use a non-peer review journal. Do not use a literature review article or systematic review article or clinical protocols as one of your articles. At least TWO of the four original research report articles MUST BE authored by nurses and published in a peer-reviewed nursing journal.  At least ONE of the two nursing research studies must address nursing practice in a non-USA country.

  • Page 1: Title page Create a title for your paper. Refer to your APA Manual.
  • Page 2: Abstract The abstract should open with a sentence that will serve as an introduction to and purpose of the paper. Then describe what is in each part of the paper. An abstract is usually a brief outline of the contents of the paper that typically does not exceed 250 words. At the end of the abstract place the phrase Key Words, and denote 3-4 keywords that would describe your paper (as for publication and indexing in CINAHL or PubMed).

    • Heading: Purpose: Clearly define the global health problem, and discuss why it is important for nursing (why you are discussing this topic).  Discuss what is known about this problem in the United States and in a non-USA country.  For example, if the focus is adult hypertension, discuss guidelines for defining hypertension in the US and in a non-USA country.  (Approximately 1 page).
    • Heading: Methods: Discuss the methods used to select the following research studies.
      Next use the subheading:
      • Sub-headings: Study #1: Nursing research Study in the USA (Approximately 1½ pages)
      • Sub-headings: Study #2: Nursing Research Study Non-USA (Approximately 1½ pages)
      • Sub-headings: Study #3: Nursing Research Study USA or Non-USA (Approximately 1½ pages)
      • Sub-headings: Study #4: Nursing Research Study USA or Non-USA (Approximately 1½ pages)
    • Heading: Conclusion.  Summarize the key points from your discussion. How would you translate (use) the new evidence found from your appraisals to change practice or answer your PICOT question? (Approximately 1 page).
