his week we examine freedom. To do this, we read about economic freedom, equality of opportunity, and equality of outcome. Like all societies throughout time, social paradoxes elevate frustration levels. You read about two inconsistencies including that while our model of modified capitalism encourages economic self-interest while our model of self-governance encourages that we voluntarily assume the role of being our brothers keeper (i. e. engaged citizenship). You also learned that Americans are not as interested in equality as they are in the sense of fairness.
Life exists in the tension between the ideal and the pragmatic (the real world). Think of an example in your life, whether at work, home, school, or during your relaxation time, when you, or someone you know, struggled with a conflict between, the way things ought to be, and the way things are. How do you do it?

Brown vs. Board of Education Case Analysis Paper – Due January 11, 2020

There is a final paper requirement in this course, which you will satisfy by performing the case analysis assignment explained below.

The paper is due at any time before the end of Session V 11:59 p.m. on January 11, 2020 and is worth 20% of your grade.

One very important part of Chapter 1 is the discussion of stare decisis and precedent, particularly in the context of some historic constitutional law case decisions.  I have attached a copy of the United States Supreme Court’s groundbreaking decision in Brown v. Bd. of Education, 347 U.S. 483 (1954).  Please read this decision and, in two to three pages: (1) summarize the finding of the Court and (2) explain both how stare decisis was applied and was not applied by the Court in its decision.  Please submit your assignments to me via e-mail at .  

Please note that the linked/attached opinion was written by Supreme Court Chief Justice Warren at a time when the use of some language that is now considered offensive and racist was deemed acceptable by some.  I just want you to note that I did not write the attached/linked opinion, nor do I condone the use of such terminology, it is the language of Chief Justice Warren of the Supreme Court in 1954.  Obviously, if you have a problem with performing an assignment on this judicial opinion, let me know and I will find another case opinion for you.

Crisis: A difficult or dangerous situation that needs serious attention
Risk: The possibility that something bad or unpleasant (such as an injury or a loss) will happen
Management: The act or skill of controlling and making decisions
Crisis and risk management are both involved with dealing with threats to an organization.  Depending on the threats faced, an organization can mitigate or eliminate the threat by implementing a management program. Both crisis and risk management deal with threats, but risk management deals with threats before the event occurs and crisis management deals with a threat as it unfolds or after the event occurs. Some of the types of crises can include natural phenomena, malfunctioning equipment, human error, confrontation (strikes, boycotts, etc.), malevolence (intentional efforts to harm a company), and flawed leadership. 

For this Assignment, you are to answer the following:

Explain the difference between risk and crisis management and the role of the National Response Framework and the National Incident Management System plays.
Do you consider crisis management a part of risk management? Justify your answer.

PART 1

Your boss has asked you to review the accident information for the CSU Widget Factory. The information he sent you is provided here.

Using the provided CSU Widget Factory OSHA 300A log, calculate the total recordable incidence rate (TRIR), the days away, restricted, or transferred (DART) rate, the lost workday injury and illness rate (LWDII), and the severity rate (SR). Be sure to show your calculations in a Word document.

Your boss wants more information on one of the accidents listed on the CSU Widget Factory OSHA 300 log. He has sent you the OSHA Form 301, Injury and Illness Incident Report, for the accident involving William Smith (available here). Mr. Smiths supervisor filled out the form, but it only includes basic information. To prepare to conduct a more thorough investigation, do the following:

Develop a list of five questions to ask Mr. Smiths supervisor about the circumstances surrounding the incident. Explain the importance of each question you create.
Select two theories of accident causation, and explain how you would use them to help in the accident investigation.

Complete a case essay on any United States Supreme Court case that involves an interpretation of the Constitution – this encompasses most of the cases that come before the Supreme Court. This will help ensure that you are writing your essay on current, relevant case law.

– How has the case moved through the legal system (who filed it, in what court? What appellate court heard it? How did it get to the Supreme Court?)?
