Please use this thread for discussions of legal implications of operating abroad for MNEs.
Since, its inception in 1998, Amazon has expanded rapidly in the UK and established itself as one of the most influential online retailers in the UK. At the core of its rapid expansion is the speed and quality of the technology and distribution network. However, questions have been raised over whether this speed and efficiency have come at an expense? Can you think of some examples of the legal concerns surrounding Amazons expansion in the UK

When organisations grow globally, they not only need to recognise the purpose, vision, priorities, policy and objectives of an organisation, but also have to take into account the problems of political, legal, economic, and environmental/ethical implications of operating an international business. In diverse legal options, ethics problems are mixed, and local customs and standards bring another dimension of difficulty to the question of how to behave both legally and ethically in an unfamiliar setting. As businesses plan a long-term expansion into a global world, to make a venture a success, they have to overcome significant moral and ethical problems and decision-making.

Some of the most common ethical issues in international business include outsourcing, working standards and conditions, workplace diversity and equal opportunity, child labour, trust and integrity, supervisory oversight, human rights, religion, the political arena, the environment, bribery and corruption.

Child labour is a highly important issue. Managers from a Western multinational would not even think about recruiting children in their home country since it would be unethical as well as disrespectful to the community’s common sense. However, in some developing economies, child labour is normal and even necessary for the child’s subsistence. Lieten (2003) states that in its thirst for higher income, global corporations raise demand for export products; the industry substitutes adults with cheaper child labour.

Corruption is also an important implication due to illicit bribery and payoffs to government officials to exploit new markets, illegally pollute countries and gain massive contracts at absurdly high costs, some multinational companies have grown wealthier and more efficient. Coomer (2013) asserts many of these influential multinational corporations are run by corporate greed, and to increase profits have abused the wealth, economies, industries, and whole countries of citizens.

Is anybody in a position to provide any examples of multinational corporations that have used bribery in their growth?

I have chosen to investigate the Swiss watch market, an industry I have been involved within for the last decade.

This luxury sector has uniquely marketed itself as acceptable indulgence. Sinclair (2015) expresses that this ability to avoid criticisms for the ostentatious nature is due to the traditional background of the industry. Brands also encouraged through advertising, such as Patek Philippes slogan You never own a Patek Philippe, you merely look after it for the next generation (Leagas Delaney, 2020); which looks to express longevity, sustainability and heritage, rather than traditional consumerism.

The perception of exceptional brands such as Rolex and Patek Philippe is as secure investments with the brands’ products increasing in value and sales through the finical downturn in 2008 (Companies House, 2020). Switzerland and their watch industry has worked hard at their global approaches and marketing mix to limit effects from wider environment fluctuations

Yet, the ability of these Swiss luxury brands to avoid negative perception and economic factors does not shield it entirely from the global environment. The PESTLE analysis below shows examples of specific global factors that are currently influence Swiss watch manufacturers.

Even just a few days ago, the UK government announced new restrictions for tax-free shopping from visitors outside of the EU, likely to reduce tourism purchases within the market (HM Treasury, 2020).

With the Political environment in turmoil, with trade wars and challenging negotiations continually creating rapid changes to business interaction, how do MNEs continue to ensure stable international growth and development

Good Evening All,

To commence this discussion, I want to highlight the different factors that multinational enterprises need to be aware of before proceeding with making any strategic decisions and attempting to enter international markets, this is because the four factors listed below can pose risk to organisations therefore analysis such as PESTLE analysis should be conducted to identify these risks to aid decision making, especially when going international.

Political

There are two categories that form the political aspect which are macro-political, which are risks such as inflation, taxation and the security risks posing a threat to all businesses in one country and the second category is micro-political, which only impacts specific firms when things such as new regulations or taxes are introduced (Wall et al, 2015).

Economic

It is important to identify and understand the economic factors that can impact an organisation which includes aspects such as exchange and interest rates, inflation, unemployment rates and more. Without exploring this adequately this would impact the growth of the business within the international market especially as the economic climate is constantly changing therefore organisations will have to adapt their strategies.

Legal

There will be different legal systems and regulatory environments world-wide therefore international managers would be required to understand the impact of the legal system specific to the market that they are looking to enter into (Wall et al, 2015).

Environmental/Ethical

Environmental and ethical implications around the world differ dependent on the country therefore just like legal implications, the organisation needs to identify areas that will impact them the most such as law regarding the environment, technological advances or how ethical behaviour can influence consumers purchasing decisions (Mamdouh, 2016).

A question to the group It is clear that MNEs looking to internationalise need to be aware of their markets by identifying these factors however, I would be interested to see if anyone feels that any particular factors are more essential than others and if so, why?
